Bias in Workplace Investigations – Investigations Podcast

In the next episode of our podcast series, Emma Bartlett, Partner, and Gabrielle Lintott, Associate, at CM Murray LLP, are joined again by Emily Kaufer, Senior Director of Human Rights and Harassment at Air Canada, to discuss the impact of bias in the context of workplace investigations.

In this recording, Emma, Gabrielle and Emily discuss bias in the workplace, with a particular focus on how bias can have an impact on workplace investigations and honing in on the following:

  • The different types of bias and how biases might manifest in the workplace
     
  • The various ways in which bias could affect an investigator’s impartiality, the investigation process and findings
     
  • How investigators might tackle complaints of bias, and the steps that an investigator can take in order to add objectivity to an investigation, maintain impartiality and monitor their biases, acknowledging that everyone has internal biases
     
  • The consequences of a biased investigation, including from a legal, cultural and reputational perspective, and the impact that a wrong or unfair outcome can have on trust and confidence within an organisation
     
  • Dealing with organisational bias and how to mitigate the impact of bias on the work that investigators do
