Issues and Challenges Related to Partnership Investigations – Constitutional Shortfalls: Ten-Minute Talk

Welcome to the first of CM Murray LLP’s Ten-Minute Talk series on Partnership and Investigations, with Senior Partner Sarah Chilton and Associate Liz Pearson.

In episode one, we start at the very beginning of an investigation (a very good place to start). Sarah and Liz discuss common constitutional shortfalls when contemplating an investigation. For example:

  • When considering the potential outcome, whether there is a power of removal for “cause”, a “no-fault” expulsion power, and other available sanctions
     
  • Whether there is a power of suspension, together with any time limitations
     
  • Who holds the decision-making power at the different stages e.g. suspension, determining potential conduct thresholds, or deciding upon expulsion
     
  • Whether there are powers related to incapacity, including payment during this period and interaction with the firm’s PHI policy
